- Included: The charter fee includes the services of a Skipper and crew, meals, standard ship’s bar, fuel, all expenses related to the running of the vessel, and use of on-board sports equipment.
- Excluded: The charter fee does not include diving, scuba equipment, premium beverages and fine wines, excessive alcohol consumption, off-yacht excursions, dockage, cruising taxes, and permits, telephone charges, airport transfers, and crew gratuities, or similar expenses incurred by the charterer.
1. GENERAL
1.1. Confirmation of activity will be subject to availability at the time of booking.
1.2. Booking will be confirmed upon a 50% deposit being made.
1.3. All CHILDREN aged 3 and below are FREE, and ages from 5-11 are charged as per the price sheets (Children's age is calculated based on month & year; activities will be restricted for safety). ALL CHILDREN aged 12 years and above will be charged at the ADULT rate.
1.4. All prices are listed in Malaysian Ringgit (MYR).
2. PAYMENT
2.1. Upon confirmation of the preferred activities and in order to secure a firm booking, full payment must be made prior to the commencement or participation in any of the activities under these Terms & Conditions. We do not guarantee any bookings without full payment.
2.2. Initial Deposit: 50% of the charter fee when the booking is made.
2.3. Remaining 50% of the charter fee and payment for any add-on options or deposit refund on cancellation is due 3 days before embarkation.
3. CANCELLATION, NO SHOW AND REFUND
3.1. Neraca Travel & Tours Sdn. Bhd. (the Company) reserves the right to change or cancel any part of the tour itinerary due to bad weather or any other unforeseen circumstances beyond their control, without prior notice as safety is our utmost priority.
3.2. In the event a client fails to turn up for the activities (“No Show”), no refund in full or in part will be given for the product services in the program not utilized. After commencement of the tour, no refund, in part or in full, will be given for services/activities in the program that are not utilized.
3.3. Deposits are non-refundable, strictly no cancellations nor date amendments are allowed once the deposit is made.
4. RESPONSIBILITIES OF CHARTERER:
4.1. Charterer agrees to stay within the approved cruising ground as provided by the Company.
4.2. Prior to check-in, Charterer will check that the boat and equipment are in good working order and up to minimum standards. At this time, Charterer can note with the Company anything it believes is contrary or below the standards as set forth.
4.3. Upon the Cruise start, Charterer is fully responsible for the Vessel and for any damage to property or injury to persons that could happen, including third parties. Even with a skipper provided by the Company, the Charterer remains responsible for the boat and the behavior and well-being of the guests.
4.4. Charterer agrees to carry only up to the number of passengers required by security rules of the boat. Charterer agrees that he/she will not transport merchandise or carry passengers for pay or have any other commercial activity.
4.5. Malaysia has strict laws regarding drug use, weapon possession, and excessive alcohol consumption aboard sea vessels. As the penalties for such activities are severe, the captain and crew have the duty to report to the authorities, and the Company reserves the right to end a charter before the scheduled end of the cruise, if any such activity takes place aboard the yacht, with a minimum of MYR 3,000 fine. If such activity persists, it is the Charterer's responsibility, and Charterer and/or official officers are to waive and release any claims which they have or may have in the future against the Company.
4.6. Any likeness or image of you or your party aboard our chartered vessel secured during your charter may be used by the Company without charge in all media for bona fide promotional or marketing purposes, including without limitation promotional materials of any kind, such as brochures, slides, videos, advertisements, and the internet.
5. INDEMNITY
5.1. The Company and its subsidiaries or affiliates are fully licensed and insured companies. Every guest participating in any of the activities is required to sign an Indemnity Form prior to commencement of the said activities. All guests will be required to read and understand its content before signing the said form.
6. INFORMATION & CONDITIONS
6.1. CHILD AGE: The minimum child age for jet ski and any on-sea activities is 7 years old. Children below 17 years old must be accompanied by a parent/guardian or an operator.
6.2. PREGNANCY: We do not allow expectant mothers to participate in any of the following activities: Parasailing, Jet ski, Banana Boat, Kayaking, Zipline, Aquapark, Boat Thrill Ride. Non-disclosure will be entirely at your own risk.
6.3. All participants must read, understand, and sign the Indemnity Forms provided. This is a mandatory requirement set by our insurance policy and The Malaysian Marine Department. All instructions from the Captains, Marshalls, Lifeguards, and staff must be strictly adhered to by guests. Failure to comply will result in security escorting you off the premises or vessel.
6.4. Security may perform searches and confiscate any illegal items for the safety of all our guests.
6.5. Max weight per Jet ski is 150kg for 2 riders.
7. HEALTH
7.1. All participants must be physically fit and able. They must, at the time of booking, advise of any illness, disability, or conditions that may affect their ability to participate in the activity. If at all unsure, guests must check with a medical practitioner before booking and must be able to produce a note from their medical practitioner if requested. Participants must bring any necessary medication with them and ensure that staff are made aware of what medicine this is and how it is to be administered. Be advised that some of the activity locations are remote and self-contained. The Company reserves the right to refuse any booking on medical grounds if the medical condition is considered to be detrimental to the safety and smooth running of the activity.
